Background:
The City Council and City Administration have received concerns regarding loud motor vehicle mufflers, modified exhaust systems, engine revving, and other loud or explosive vehicle exhaust noises in the Rose District. The City's existing Code contains provisions addressing disturbing the peace and modified vehicle exhaust systems. However, Section 16-7(a)(7) currently provides a limited Rose District area exemption from certain disturbing-the-peace provisions during specified weekend hours.
The proposed ordinance would narrowly amend Section 16-7(a)(7) to clarify that the Rose District area exemption does not apply to loud or explosive noises created by the discharge of exhaust from an internal combustion engine or motor vehicle. The purpose of the amendment is to preserve the existing Rose District accommodation for restaurants, music, events, and normal downtown activity while clarifying that the exemption does not protect loud mufflers, modified exhaust, engine revving, or explosive vehicle exhaust noise.
The proposed amendment would not replace existing enforcement authority under Chapter 23 relating to mufflers and modified exhaust systems. Rather, it would clarify that vehicle exhaust noise remains subject to enforcement within the Rose District area, including during the extended weekend hours otherwise addressed by Section 16-7(a)(7).
