Approval of and authorization to execute a Parks and Recreation Use Agreement between the City of Broken Arrow and the Broken Arrow Youth Football Association and Broken Arrow Lacrosse Club

Background:
The attached Use Agreement grants a non-exclusive license to allow the Broken Arrow Youth Football Association (BAYFA) and the Broken Arrow Lacrosse Club (BALC) to use the football fields at Nienhuis Park Complex located at 3201 N. 9th Street in Broken Arrow. The use of the fields will allow BAYFA and BALC, registered non-profit organizations to operate a youth football program and lacrosse program.
The BALC was the subject of an addendum to a prior Use Agreement. In addition to making BALC as a specific party, other revisions to the Use Agreement include the following:
• BAYFA and BALC will be permitted to schedule and charge for use of the fields to third parties, but the City will still receive a Per Game fee for usage.
• A multi-year term for use of the fields.
• BAYFA and BALC will supply, solely at their own expense, dumpster service.
• Added clause allowing BAYFA and BALC the option of taking over line painting.
This Use Agreement will commence upon execution and end on December 31, 2019. Staff recommends that the Council approve the Use Agreement and authorize its execution.
