Background:
The City of Broken Arrow's Right of Way Agent contacted Phil Roland, the property owner in relation to purchase, fee simple of a permanent easement acquisition for the Stone Ridge Stormwater Detention. In September 2021, the city sent Roland Investments, Ltd., an offer letter in the amount of $513,000.00. Received an updated appraisal, the amount was $245,000.00. The appraiser advised that in updating this appraisal there was a reduction in value due to parcels being split from the original tract and the drainage area being lower than the roadway, topography and access being inferior, compared to the remainder of the land is far superior.

The City's right-of-way agent has attempted unsuccessfully to negotiate with Mr. Roland, the owner of Parcel 1.0, located at Southwest corner of Elm Place and Albany Street, Broken Arrow, Oklahoma, Section 3, Township 18 North, Range 14 East. The attached Resolution of Necessity No. 1602 recommends that condemnation proceed on Parcel 1.0, for the fee simple purchase of the Permanent Stormwater Easement.

Cost: $245,000.00 plus costs
