Background:
The attached Use Agreement grants a non-exclusive license to allow Broken Arrow Community Playhouse (BACP), a registered non-profit organization, to use the Main Place Playhouse which is located at 1800 South Main Street in Broken Arrow. The City has had the Agreement with the BACP for several years. Revisions to the proposed Use Agreement include the following:

* City agrees to pay for the electrical and natural gas costs of the Main Place Playhouse during the full term of the Agreement, which shall not exceed $14,200.00 per calendar year.
* BACP will manage all scheduling and third party reservations.
* BACP shall maintain, replace or repair any minor maintenance item that is considered routine in nature and the City shall maintain, replace or repair any major maintenance item that is not considered routine in nature.
* BACP shall perform all custodial duties as needed and on regular basis to ensure cleanliness of the facility.
* BACP shall supply commercial dumpster service at BACP expense.
* BACP's term for usage will commence upon approval and end on June 30, 2016.

Funding for additional services was included in the FY 2015-16 Budget.

Staff recommends that the Council approve the Use Agreement and authorize its execution.

Cost: Not to exceed an amount of $14,200.00 per calendar year.
