Background:
In order to provide improved and safer access to the Events Park, Rosewood Elementary School, and Arrow East Industrial Park from State Highway 51, the City, in conjunction with the design consultant HDR, have been coordinating with Union Pacific Railroad (UPRR) to construct a new at-grade crossing at 43rd street. UPRR has provided the attached agreement which will allow the construction of the new at-grade railroad crossing at 43rd Street.
This agreement governs responsibilities for the City pertaining to the railroad crossing improvements. Per this agreement, the City is responsible to pay all costs for construction, by UPRR, of the railroad improvements necessary for the 43rd Street crossing, which is currently estimated at $761,625.00. Additionally, this agreement requires the City to pay a one-time fee of $21,888.00 for right to facilitate construction of the 43rd Street crossing on UPRR property. A set fee of $15,192.00 per year, beginning 3 years after execution of this agreement and paid in advance by the City, but subject to re-determination by UPRR beginning five years after execution of this agreement, for UPRR to provide surface and signal maintenance of the crossing between the ends of the railroad ties. The City is responsible for all construction and maintenance of the 43rd Street crossings within railroad right-of-way up a distance of two (2) feet outside of the rails themselves.
This agreement also requires closure of the existing 219th East Avenue at-grade railroad crossing after the new 43rd Street crossing is complete and open to traffic.
