Background:
In order to install pedestrian crossings over the railroad adjacent to Kenosha Street between Sycamore Avenue and Redbud Avenue, staff worked with Union Pacific Railroad (UPRR) and a design consultant to produce engineered plans for construction of necessary railroad improvements to facilitate said pedestrian crossings. UPRR requires execution of the attached Public Highway At-Grade Crossing Agreement by the City prior to start of construction of planned improvements.
This agreement governs responsibilities for the City pertaining to the railroad crossing improvements. Per this agreement, the City is responsible to pay all costs for construction, by UPRR, of the railroad improvements necessary for the pedestrian crossings, which is currently estimated at $89,984.00. Additionally, this agreement requires the City to pay a one-time fee of $15,000.00 for right to facilitate construction of pedestrian crossings on UPRR property. A set fee of $805.00 per year, beginning 3 years after execution of this agreement and paid in advance by the City but subject to re-determination by UPRR beginning five years after execution of this agreement, for UPRR to provide surface maintenance of the crossings between the ends of the railroad ties is also included in the agreement. The City is responsible for all construction and maintenance of the pedestrian crossings within railroad right-of-way up a distance of two (2) feet outside of the rails themselves.
With approval of this agreement, staff would move forward with UPRR to begin construction of the proposed pedestrian crossing improvements.
