Background:

The property owner, or their authorized representative, has submitted an application requesting the closure of an unused Right-of-Way on property located one-half mile south of West Kenosha Street (71st Street), and one-fourth mile west of South 9th Street (177th E Ave). This right of way was once an alleyway for 9 separate properties which are all now under the ownership of the applicant.

The property is planned to be developed as part of the Broken Arrow Public Schools Natatorium. 

 The location and details of the easement to be closed are detailed in the “Utility Easement Closure - Exhibit ‘A’” attachment.

Staff have reviewed the request and recommend acceptance of the easement closure. There is a minor error in the inset map in the exhibit, but this will be corrected prior to adoption of the ordinance. This error is minor and does not change the overall location or legal description of the right of way to be closed.
