Approval of and authorization to execute Amendment No. 1 to Employment Contract for Professional Services with Dennis Sagely as Alternate Judge for the City of Broken Arrow's Municipal Court

Background:
The City of Broken Arrow and Dennis Sagely entered into an Agreement on May 3, 2016, for Professional Services as Alternate Judge for the City of Broken Arrow’s Municipal Court. Currently, the City’s Presiding Judge overseas all Municipal Jury Trial Dockets, which includes preparing for and attending all Sounding Dockets and Jury Trials. In some instances, the Presiding Judge may be unavailable to preside over a case due to an illness, conflict of interest or other similar circumstance. As a result, the Alternate Judge will need to preside over certain Jury Trials.
The current Contract with Judge Sagely makes no provision for presiding over Jury Trials. As such it is appropriate to amend the Contract to provide for payment. The Legal Department recommends that he be compensated at the rate of One Hundred Dollars ($100.00) per hour for performing this function. The attached Amendment No. 1 incorporates this change into the original Contract. Staff recommends that the Council approve the Amendment and authorize its execution.
Cost: $100.00 per hour to preside over Municipal Court Jury Trials
