Background:
In alignment with the budgetary allocation in the Broken Arrow Capital Outlay Sales Tax Capital Improvement Fund 330, funds have been approved for the purchase of one (1) F-350 Extended Cab truck equipped with a 7-yard Curbtender manual side loader for the Parks Department. This acquisition is identified under Project Number 2660040 in the FY2026 Vehicle Replacement Plan.
To maximize the City's resources and leverage cost efficiencies, the Maintenance Services Department recommends procuring the refuse truck through the Oklahoma Statewide Contract SW035. This contract enables municipal agencies across Oklahoma to purchase vehicles at pre-negotiated state contract pricing, eliminating the need for a separate bid process while providing substantial cost and administrative savings. Utilizing State Contract SW035 ensures compliance with budgetary constraints while securing a durable, high-quality asset for the Parks Department.
Section 2-27(b)(5) of the Broken Arrow Code of Ordinances provides an exception to the competitive bidding process for supplies, materials, equipment, or contractual services purchased at a price not exceeding that set by the state purchasing agency, any other state agency authorized to regulate prices, or from purchasing consortiums.
In addition, Section V.d of the Broken Arrow Purchasing Manual authorizes purchases from "the state contract or other purchasing consortiums," noting that such purchases eliminate the need for formal competitive bidding. State Contract SW035 qualifies under both the Code of Ordinances and the Purchasing Manual.
