Background:

Discover Financial Services, DFS Services LLC, and Discover Bank (together “Discover”) have been sued in three related lawsuits in the United States District Court for the Northern District of Illinois. The lawsuits allege Discover misclassified certain Discover-issued consumer credit cards as commercial credit cards, resulting in merchants incurring excessive interchange fees. Although Discover contests the allegations, Discover has agreed to settle the lawsuits to avoid further litigation. The City has received several Court-Approved Claim Forms identifying the City as an eligible Settlement Class Member. Resolution No. 1717 grants the City Manager the authority to take any necessary actions, on behalf of the City of Broken Arrow, to engage and effectuate the City’s participation, release, and settlement of the City’s claims related to the Discover Class Action Settlement.
