Background:
The attached use agreement grants a non-exclusive license to allow R.C. Dickenson Family YMCA of Greater Tulsa (YMCA) to use Country Aire Swimming Pool and associated facilities (Premises) located at 100 North Fir Avenue in Broken Arrow. The goal of this contract is to increase programming and usage of Country Aire Swimming Pool for the benefit of the public, YMCA members, and the City of Broken Arrow.
Highlights of the Use Agreement include:
* YMCA will be permitted to complete all scheduling of Premises to third party rentals.
* YMCA agrees to hire all staff to operate a municipal swimming pool, including certified lifeguards, managers, and maintenance personnel.
* YMCA agrees to operate the swimming pool in full compliance with all Federal, State, and/or Local applicable codes, regulations, and rules.
* YMCA shall have Premises available to the public at least five days per week, weather permitting.
* City will be responsible for the $100 licensing fee.
* City agrees to pay up to $1,500 in pool chemicals to help offset the cost of operations of the Premises for the YMCA. YMCA will be invoiced for any additional cost of chemicals.
* YMCA will retain all admission fees, rental fees, and program fees to help offset the operating cost.
* YMCA will not be charged a user fee for operating and programming of the Premises.
* This will be the third year that the YMCA has operated the Country Aire swimming pool.
This Use Agreement will commence on May 1, 2016, and end on September 30, 2016.
Cost: $1,500 for pool chemicals, $100 for licensing fee, estimated utilities for the 2016...
