Approval of and authorization to execute a Professional Services Agreement between the City of Broken Arrow and Brewster & De Angelis, P.L.L.C., Attorneys at Law

Background:
Guy A. Fortney of Brewster & De Angelis, P.L.L.C. is a well-respected attorney with vast legal knowledge and experience involving Federal §1983 actions. The City Attorney is recommending that the Council engage this firm to assist the City and the Broken Arrow Police Department in the defense of civil cases filed against the City and members of the Police Department regarding the Elton Fernandes matter. A civil rights suit was brought against the City of Broken Arrow, Officer Craig Brown, and Officer Mike Jackson in the United States District Court for the Northern District of Oklahoma under case number: 16-CV-630-CVE-FHM. The attached Professional Services Agreement memorializes this arrangement, costs, and the hourly rates to be charged.
Cost: Hourly rate as set forth in the Agreement: $200.00 per hour for
Partners, $150.00 per hour for Associates, and $75.00 per hour for
Paralegals
