Background:
The Sewer Division of the Utilities Department has budgeted for the purchase of a Kubota KX033-4R3A Hydraulic Excavator from Stewart Martin Kubota of Broken Arrow. A quote has been received through the Sourcewell Cooperative Purchasing Contract (formerly NJPA) #082923-KBA, City Membership ID #67325. Funding for this purchase is available in the Broken Arrow Municipal Authority (BAMA) Capital Improvement Fund in the amount of $90,500.00.
The quote includes the KX033-4R3AE machine, a BR360 Series Breaker, 12-inch trenching bucket, 24-inch trenching bucket, quick coupler, and an extended two-year warranty. The quoted base pricing also provides a 24-month/2,000-hour full machine warranty and an additional 24-month/4,000-hour warranty, for a total warranty period of four years or 4,000 hours, whichever comes first.
Section 2-27(b)(5) of the Broken Arrow Code of Ordinances provides an exception to the competitive bidding process for supplies, materials, equipment, or contractual services purchased at a price not exceeding that set by the state purchasing agency, any other state agency authorized to regulate prices, or from purchasing consortiums. In addition, Section V.d of the Broken Arrow Purchasing Manual authorizes purchases from "the state contract or other purchasing consortiums," noting that such purchases eliminate the need for formal competitive bidding. Sourcewell qualifies as a purchasing consortium under both the Code of Ordinances and the Purchasing Manual.
This model was selected because it meets the operational size and performance requirements of the Utilities Division and ensures local dealer support for service and parts.
