                     Acceptance of a Deed of Dedication from Larry and Joni Carmack on an unplatted parcel of land located in the northeast corner of 9th Street and New Orleans Street, Broken Arrow, Tulsa County, State of Oklahoma, (Section 24, T18N, R14E)

Background:

The property owner, Larry Carmack submitted an application requesting the acceptance of a Deed of Dedication for the purpose of providing Right-of-Way access on an unplatted property adjacent to New Orleans Street and east of 9th Street. Mr. Carmack is in the process of making improvements to his property including a garage, swimming pool and pool house.

 

The submitted Right-of-Way exhibit drawing, has a 15 foot “LESS & EXCEPT” strip of land near the south boundary along New Orleans Street referenced as Document No. 2007094577. This portion of land does not belong to Mr. and Mrs. Carmack.  The City of Broken Arrow purchased this Right of Way from Jim Kelly Real Estate, LLC (Parcel #6), for the purpose of widening New Orleans Street. The General Warranty Deed was recorded in Tulsa County on August 22, 2007.

 

Staff has reviewed the documents and recommends acceptance of the deed of dedication.
