Approval of a Vacation of the Plat of BOL Addition, a subdivision of the City of Broken Arrow, Wagoner County, State of Oklahoma, (Plat No. PLC5-409B, 2010) generally located north of State Highway 51 and west of Oneta Road (Section 21, T18N, R15E); subject to the platting of Kum & Go #837

Background:
The applicant, Cameron Smith, Olsson Associates, submitted an application on behalf of Kum & Go requesting the Vacation of the Plat "BOL Addition" and proposes to replat it as Kum & Go #837. The property is currently platted as Lot 1, Block 1, BOL Addition.
The BOL ADDITION plat was a replat of Lots 10 and 11, Block 2 of Prairie Dale Addition, filed as, BOL ADDITION, Lot 1, Block 1, PLC5-409B, June 4, 2010, Wagoner County, State of Oklahoma.
The property was originally platted as Prairie Dale with Wagoner County, Oklahoma on August 4, 1970 in Plat Book 4 Page 27 (the "Plat"). A CERTIFICATE TO VACATE PLAT IN PART OF PRAIRIE DALE , Lot Ten (10), Block Two (2) and Lot Eleven (11), Block Two (2) was filed December 29, 2011, Document No. 2011-14571 Book: 1990 pg: 602, Wagoner County, State of Oklahoma.
The portion being vacated will be replaced by the new plat, named Kum & Go #837. The Preliminary Plat and PUD-247 for Kum & Go #837 was heard and approved by the Planning Commission on January 14, 2016. The proposed plat includes all required rights-of-way and easements.
Staff has reviewed the documents and recommends approval of the Vacation of Plat, subject to the platting of Kum & Go #837. There are no objections from public utilities to the Vacation of BOL Addition. The owner/representative will file the approved plat for Kum & Go upon receipt of Council approval for this vacation of plat.
