Background:
Wagoner County Board of County Commissioners (“County”) filed a condemnation action (Case No. CV-26-26) to acquire property interests for the S 273rd E Ave - Phase 2 project. The City of Broken Arrow was named as a defendant due to the City’s recorded drainage easement (Book 950, Page 658). The property owner’s just compensation is $12,100.00, to be paid by the County directly to the owner. The City makes no claim to any portion of the just compensation award. The judgment expressly preserves the City’s rights under the drainage easement recorded at Book 950, Page 658. Each party bears its own attorneys’ fees and costs.
The County has confirmed the acquisition does not interfere with the City’s drainage easement, and the proposed Agreed Judgment preserves all City rights under the drainage easement.
