                     Approval of and authorization to execute a Second Amendment to the Site Lease Agreement between the City of Broken Arrow and Crown Castle for AT&T Wireless

Background:

City Staff received notice from Crown Castle on behalf of AT&T of their request to amend the terms of their use/lease agreement for a tower located at the City of Broken Arrow Maintenance Facility at 1700 W Detroit Street.  The current terms of this lease are for approximately 2500 square feet of ground space at a monthly rate of $400.00.  This lease provides for a 5-year term with three 5-year renewal options that include a 15% increase in rent each renewal term.

                     

The amendment allows for early renewal to the current lease and increases the monthly lease payment to $1,700.00 per month.  The amendment provides an option of seven additional five-year renewals that include a 15% increase in rent each renewal term.  Staff recommends that the Council approve the Second Amendment to Site Lease Agreement and authorize its execution.
