Background:

Effective November 1, 2015, State Statute 47 O.S. 11-1112 which regulates child passenger restraint systems will be amended. The amendment requires children under four (4) years of age to be secured in a child restraint system. It will also require children two (2) years and younger to be secured in a rear facing child restraint system or until the child reaches the weight and height limit of the rear-facing child restraining system as allowed by the manufacturer.  For children at least four (4) years of age but younger than eight (8) years of age, if not taller than 4 feet 9 inches in height, will be required to be secured in either a child passenger restraint system or a child booster seat. The attached Ordinance amends Section 23-37 of the Broken Arrow Code of Ordinances to bring her into compliance with State Statute.
