Background:
Scott B. Wood with the law firm of Wood, Puhl & Wood, P.L.L.C., is a well-respected attorney with vast legal knowledge and experience involving defending civil rights cases brought against police officers and municipalities. The City Attorney recommends that the Council engage this firm to provide representation of the City, Sergeant Eric Nester, Sergeant Stephen Garrett, Chief David Boggs, and Officers John Doe regarding the case of Wilson v City of Broken Arrow, et al, Case number CJ-2017-1521, and legal advice regarding risk management and civil cases filed against the City and members of the Police Department.

The attached Professional Services Agreement memorializes retention of the firm, costs and the hourly rates to be charged. The firm charges the following rates:

Attorney (Scott B. Wood): $250.00 per hour maximum
Associates: $185.00 per hour maximum
Paralegals: $90.00 per hour maximum

The Professional Services Agreement provides that the maximum fees and costs shall not exceed $25,000.00. Staff recommends that the Council approve the Professional Services Agreement and authorize its execution.

Cost: Not to exceed $25,000.00.
