Background:
Purpose and intent of this Ordinance is to protect public ways and the City stormwater system from concrete residue and wash water. The Ordinance provides definitions for concrete, concrete wash water, effective containment (examples include chute-closure devices, catch pans/bins, drip trays, lined containment, vacuum recovery, or equivalent methods), public right-of-way, and stormwater system.
The Ordinance also makes it unlawful to discharge, deposit, spill, allow to escape, or track concrete, slurry, wash water, or other construction materials onto or into the ROW or stormwater system. This Ordinance requires the operator to implement effective containment when a chute, hopper, or equipment is used within, from, or over the public ROW, while expressly stating the ordinance does not impose vehicle equipment requirements beyond state law (i.e., compliance can be achieved operationally). Also requires washout only in a designated containment area on private property (or as otherwise authorized by permit) and prohibits dry-brooming or flushing into gutters, inlets, or ditches. The Ordinance further requires immediate cessation and prompt removal/disposal; requires immediate notification to the Stormwater Division if materials enter storm drains, inlets, ditches, channels, or watercourses.
This Ordinance authorizes City cleanup if the party responsible fails to do so, and recovery of actual costs, in addition to penalties. This Ordinance establishes civil offense penalties. Each act and each day may be a separate offense; includes permit suspension or revoc...
