Background:

On February 15, 2024, John Winningham, Jr. filed a pro se Complaint in the Northern District of Oklahoma alleging Officer Leon Rademacher, and others, conspired, abused process and maliciously prosecuted Plaintiff Winningham. Plaintiff also makes claims of theft of property and fraud.  This suit arose from an arrest of Mr. Winningham on July 31, 2018 as a result of a warrant from Sequoyah County.  Title 11 O.S. § 23-101 et seq. provides for the City of Broken Arrow to defend its municipal employees in such actions. Officer Leon Rademacher acted in good faith and in the course and scope of his employment in this encounter and is entitled to a defense by the City of Broken Arrow.
