End
Background:
The Oklahoma Department of Environmental Quality (ODEQ) and the City of Broken Arrow negotiated Consent Order Case No. 25-253 to address sanitary sewer overflows within the City’s wastewater collection system. The order provides an updated compliance schedule and, upon becoming effective, supersedes and closes Consent Order No. 19-180 and its subsequent addendum. Utilities staff and the City’s Legal Department reviewed the terms and coordinated with ODEQ to establish the required improvements and completion schedule.
The Consent Order outlines a phased rehabilitation program for sewer subbasins LL30 and LL33 to reduce inflow and infiltration and improve collection system reliability. Required activities include in-house repairs, three phases of rehabilitation, and subsequent flow monitoring to evaluate the effectiveness of the improvements. Rehabilitation is scheduled for completion by July 1, 2030, with follow-up monitoring and an engineering report due by May 1, 2031. ODEQ is not assessing additional penalties at this time; however, stipulated penalties may apply if required deadlines are not met.
Mayor Debra Wimpee signed the Consent Order on September 15, 2026. This item is presented for City Council acknowledgement of the Mayor’s signature and the City’s commitments under the order.
