Approval of and authorization to execute a Memorandum of Understanding by and between the City of Broken Arrow and Kim Banning for the furnishing of labor and materials on property located at 1701 South 3rd Street in Broken Arrow and Acceptance of a Temporary Construction Easement

Background:

City staff met with the owners of 1701 S 3rd Street at their property on June 1, 2026.  During this meeting, the residents stated that the City damaged the retaining wall on the rear of the property when the channel was cleaned around December 2024.  The owners later met with the City Manager’s Office and the Engineering and Construction Department on June 11, 2026.  The outcome of that meeting was an agreement that the City would replace the timber retaining wall.  The estimated replacement cost is $3,500.00.

The attached Memorandum of Understanding outlines the work the City will perform within the attached Temporary Construction Easement.
