Background:
On August 3, 2026, the Broken Arrow Municipal Authority approved Agenda Item No. 26-1155, awarding the most advantageous proposal for Bid No. 26.161, Natural Gas Commodity Supply, to Symmetry Energy Solutions. The award was based on Symmetry Energy Solutions' proposed 36-month fixed, all-in price of $3.64 per dekatherm under a full-requirements natural-gas supply arrangement.
The City's solicitation, as clarified by Addendum No. 2, defined "Full Requirements" as an arrangement under which the successful supplier would provide 100% of the City's natural-gas commodity requirements for the awarded locations and assume responsibility for commodity procurement, nominations, scheduling, balancing, and supply management.
Following the award, Symmetry Energy Solutions provided the City with a proposed agreement containing volume commitments, usage-variance provisions, imbalance charges, market-priced overages, unused-volume buyback provisions, and other terms that could shift weather-related usage and market-price risks to the City. These provisions are materially different from the fixed-price, full-requirements arrangement the City intended to obtain through the solicitation.
After further review and consultation with the City Attorney's Office, staff determined that the parties are unable to enter into an agreement consistent with the requirements and intent of Bid No. 26.161. No final agreement or transaction confirmation has been authorized or executed by the City.
Staff therefore recommends rescinding the award to Symmetry Energy Solutions previously approved under Agenda Item No. 26-1155. Staff intends to revise and reissue the solicitation to more clearly define the acceptable pricing structures, vo...
