Approval of and authorization to execute the Third Amendment to the Site Use/Lease Agreement at Tiger Hill with Sprint Spectrum Realty Company, LLC (T‑Mobile)
End
Background:
The City of Broken Arrow and Sprint Spectrum Realty Company, LLC (T-Mobile) entered into a Site Use/Lease Agreement for the Tiger Hill communications site on May 5, 2010, later amended in 2015 and 2016 for equipment and rent updates. The proposed Third Amendment establishes five additional five-year renewal terms that automatically extend the lease unless either party provides advance written notice-365 days for the City, 30 days for T-Mobile. The Commencement Date for this Third Amendment is the date it is approved by the City Council and fully executed by all parties.
The amendment revises the rental structure, setting monthly rent at $2,500 for the first renewal term and applying a 15% escalation at the start of each subsequent renewal term beginning May 1, 2035. It also authorizes T-Mobile to complete certain equipment upgrades within the existing leased footprint at no additional cost, provided all permits and safety standards are met. All other provisions of the original lease remain unchanged unless specifically modified by this amendment.
