Approval of and authorization to execute a Site Use/Lease Agreement between the City of Broken Arrow and Cellco Partnership d/b/a Verizon Wireless for placement of wireless facilities located in the general area of 3093 North Elm Place and a Memorandum of Lease Agreement

Background:
Representatives of Cellco Partnership d/b/a Verizon Wireless made a request to enter into a Site Use/Lease Agreement (Lease) for the placement of wireless facilities on the City of Broken Arrow’s water tower which is located at 3093 North Elm Place. The Lease provides for approximately 480 square feet of ground space and tower space at a monthly rate of $2,500.00. It also provides for an access easement. The initial term of the Lease is for five (5) years, with three 5-year renewal options that include a 15% increase in rent for each renewal term.
The Lease is consistent with others utilized by the City and contains standard provisions such as insurance requirements and hold harmless waivers. Staff recommends that the Council approve the Site Use/Lease Agreement and authorize its execution.
