Background:
In 2014, Broken Arrow residents approved expenditure of General Obligations Bonds to purchase land for an arts center to be located in central Broken Arrow. There is additional funding for the project from the Vision 2025 surplus funding for a total project amount of $4,000,000.
Oklahoma Statutes, Title 61, Public Building and Public Works, which govern the construction of facilities, allows for other project delivery method as opposed to the most common and recognized Design-Bid-Build method. Two (2) other methods detailed in the state statute include Design-Build and Construction Management delivery methods. In order for a public entity to use one of these other project delivery methods, the entity must demonstrate that the project meets with specific criteria depicted in the Public Facilities Act.
The project will consist of a woodshop, art gallery, film and sound studio, "dirty" maker space, and a kiln room, which all require specialized and complex construction methods due to the unique nature of the facility as described in Exhibit "A". This project will be for the benefit and use by the public. And, due to the limitation of funds available for this project and the proposed cost, there is a certain necessity to control costs during the construction of the project due to the specialized equipment, fixtures and features of the facility.
Therefore, staff concludes that the construction management project delivery method is necessary for construction of the Center for Arts, Innovation and Creativity.
