Background:

On November 1, 2015, amendments to State Statute, 47 O.S. 11-1112, which regulates child passenger restraint systems, become effective.  The amendment requires children under four (4) years of age to be secured in a child restraint system. It also requires children two (2) years and younger to be secured in a rear facing child restraint system or until the child reaches the weight and height limit of the rear-facing child restraining system as allowed by the manufacturer.  Children at least four (4) years of age, but younger than eight (8) years of age, if not taller than 4 feet 9 inches in height, will be required to be secured in either a child passenger restraint system or a child booster seat.

Section 23-37 regulates child passenger restraining systems.  This section of the Broken Arrow Code of Ordinances, must be amended to reflect the changes in State Statute.  Staff recommends that the Council preview the ordinance and set it for adoption.
