Background:
On May 20, 2026 the City of Broken Arrow received a Notice of Violation (NOV), SWM-040001-26-1, from the Oklahoma Department of Environmental Quality (ODEQ) in relation to the private subdivision The Retreat located on New Orleans Street south of Oliver Middle School.
The City of Broken Arrow disagrees with ODEQ’s determination that the City failed to exercise enforcement authority under its Municipal Separate Storm Sewer System (MS4) program. As such, the City is writing a letter replying to the NOV.
