Ratification of an Amendment to the Regional Metropolitan Utility Authority (RMUA) Operation Agreement regarding the Haikey Creek Wastewater Treatment Plant extending the time period from 42 to 43 years

Background:
The Broken Arrow Municipal Authority (BAMA) has an item on its agenda to ratify an amendment to the City of Tulsa’s contract with the Regional Metropolitan Authority (RMUA), to extend the agreement for Haikey Creek Wastewater Treatment Plant from 42 to 43 years. The original “Service Contract,” was executed on February 13, 1974, for a period of 40 years. The original contract was extended for one (1) year at the December 2, 2014, BAMA meeting. The attached amendment to the original Agreement extends the time for an additional one (1) year to allow time for RMUA to make amendments to the contract based on input from TMUA and BAMA staff. Ratification of this Amendment is required by both the Council and BAMA. Staff recommends that the attached Amendment be ratified.
