Background:
VENU has requested a one-time waiver of Section 16-12 of the Broken Arrow Code of Ordinances for a New Year’s Eve concert at Regent Bank Amphitheater. The proposed event would begin on Thursday, December 31, 2026, and continue into the early morning of Friday, January 1, 2027. VENU anticipates featuring a nationally touring artist and requests that amplified concert sound be allowed to continue until 1:00 a.m. so that the performance can include the New Year’s countdown.
Section 16-12(a)(8) provides an exemption for noise at Broken Arrow Events Park and the adjacent amphitheater between 10:00 p.m. and 11:00 p.m. Sunday through Thursday. That exemption does not extend beyond 11:00 p.m. Section 16-12(c)(4) authorizes the City Council to grant a waiver for noise resulting from an activity of temporary duration.
The requested waiver would apply only to amplified concert sound generated at Regent Bank Amphitheater between 11:00 p.m. on December 31, 2026, and 1:00 a.m. on January 1, 2027. All amplified concert sound must cease by 1:00 a.m. The waiver would apply only to this event and would not amend Section 16-12 or alter any other applicable land use approval, permit, agreement, or legal requirement.
