Background:

On May 20, 2026 the City of Broken Arrow (City) received a Notice of Violation (NOV), SWM-040001-26-1, from the Oklahoma Department of Environmental Quality (ODEQ) in relation to the private subdivision The Retreat located on New Orleans Street south of Oliver Middle School.

The City wrote a letter replying to ODEQ disagreeing with ODEQ’s determination that the City failed to exercise enforcement authority under its Municipal Separate Storm Sewer System (MS$) program.  This letter also outlines how the City is in compliance with its MS4 program.

Attached is the letter to ODEQ dated June 26, 2026.
