Background:
The contractor requests a variance of Section 16-12(a)(6) of the Broken Arrow Code of Ordinances to permit temporary construction activity noise outside of the hours of 7 a.m. and 10 p.m.
During the summer months, larger concrete placements must begin in the early morning hours to provide adequate time for placement, finishing, and curing before daytime temperatures rise. To accommodate these conditions and ensure the quality and integrity of the work, Myers Cherry Construction anticipates three to four occasions when concrete placement activities may need to begin as early as 2:00 a.m.
The contractor respectfully requests the Council grant the variance to waive the noise ordinance to permit concrete pouring to begin at 0200, Monday - Saturday for six consecutive weeks to be coordinated with the Engineering and Construction staff. If the necessary construction work is not completed within such time frame, one (1) day extensions may be administratively approved by the Director of Engineering & Construction for good cause shown, with a maximum of ten (10) such extensions permitted. Any additional extensions will require Council approval
