Approval of and authorization to execute a construction variance for Eller & Detrich at the Adams Creek Town Center Development

Background:

The contractor request a variance of Section 16-12(a)(6) of the Broken Arrow Code of Ordinances to permit temporary construction activity noise outside of the hours of 7 a.m. and 10 p.m.

                     The subject property is part of the Adams Creek Town Center, located on East Hillside Drive, north and west of the northwest corner of E. Kenosha Street and County Line Road. The property owner has received the necessary permits the commence construction on the Property. The requested waiver is for purpose of pouring the concrete building slabs, which is highly dependent on weather and heat conditions. Additionally, significant weather delays have already occurred due to the particularly rainy summer. In order to ensure the project remains on schedule and the concrete can set properly, concrete will need to be poured in the early morning hours.

                     The contractor respectfully requests the Council grant the variance to waive the noise ordinance to permit concrete pouring to begin at 0400, Monday - Saturday from 9 October - 30 October 2025. If the necessary construction work is not completed within such time frame, one (1) day extensions may be administratively approved by the Director of Engineering & Construction for good cause shown, with a maximum of ten (10) such extensions permitted. Any additional extensions will require Council approval
