Background:

Previously, the City Council authorized the City Manager, on behalf of the City of Broken Arrow, Oklahoma, to take appropriate actions necessary to engage in settlements with opioid manufacturers (See Resolution No. 1700). This Resolutions ratifies, authorizes, and affirms the City’s approval of and participation in settlements reached with Purdue Pharma L.P. and its related entities (“Purdue”), and Sackler family members as officers, directors, managers, and shareholders of Purdue (the “Sacklers”), as well as the generic opioid manufacturers Alvogen, Inc., Amneal Pharmaceuticals, Inc., Apotex, Inc., Hikma Pharmaceuticals USA, Inc., Indivior Inc., Mylan Pharmaceuticals Inc., Sun Pharmaceutical Industries, Inc., and Zydus Pharmaceuticals. Further, this Resolution approves and ratifies the actions of its legal counsel in executing documents necessary for the City to effectuate these settlements, including execution of the Purdue State-Subdivision Agreement and the State-Subdivision Agreement applicable to the settlements with the generic opioid manufacturers.
