Background:
The City of Broken Arrow's Right of Way Agent contacted the J. Michael Ritze, the property owner in relation to easement acquisition for the County Line Trunk Sewer, Phase II. On 03/23/2023 I met Mr. Ritze on site, his residence to discuss this upcoming project. I discussed all details, provided plan sheets and easement diagrams. Received an email from Jim Stephens, Mr. Ritze's broker advising Mr. Ritze advised me to order the appraisal. Mr. Ritze received an offer letter based on the appraisal for $78,200.00. Sent Hugh Robert, Mr. Ritze's attorney a copy of all documents. On 01/31/2024 the city received a counteroffer from Sarah Marshall, Mr. Ritze's attorney advised that Mr. Ritze calculated the amount of $633,634.80. On 02/01/2024 I received another counteroffer $591,000.00 based on their appraisal. In speaking with Mr. Robert, it appeared that this underground easement was no different that buying a roadway easement in a business district even though it is a rural area.

The City's right-of-way agent has attempted unsuccessfully to negotiate with Mr. Ritze, the owner of Parcel 21.0 and 21.1, located at 18574 East 101st Street, Broken Arrow, Oklahoma, Section 25, Township 18 North, Range 14 East. The attached Resolution of Necessity No. 1590 recommends that condemnation proceed on Parcel 21.0, 21.1, for the Utility Easement and Temporary Construction Easement.

Cost: $78,200.00 plus costs
