Approval of and authorization to execute a Parks and Recreation Use Agreement between the City of Broken Arrow and the Broken Arrow Amateur Basketball Association

Background:
The attached Use Agreement grants a non-exclusive license to allow Broken Arrow Amateur Basketball Association (BAABA) to use the Central Park Community Center gymnasiums and the Nienhuis Park Community Center gymnasiums (Premises). The use of the Premises is to allow BAABA, a registered non-profit organization, to operate a youth basketball program to the citizens of Broken Arrow.
Changes made to the contract include.
• Updated dates that BAABA may use the Premises.
• New billing method has been adopted for this agreement.
o BAABA was paying 50% of the electric bill which was based off a percentage of the square footage at each facility used.
o New billing is a flat rate of $6 per gym per day. This amount is very comparable to the amount BAABA was paying during the previous billing method.
This Use Agreement will commence upon execution and end on March 31, 2017. Staff recommends that the City Council approve the Use Agreement.
