Background:

PT15-119A is the Conditional Final Plat of Kum & Go #837, a replat of Lot 1, Block 1 of BOL Addition and Lot 9, Block 2 of Prairie Dale Addition. This Conditional Final Plat contains 3.33 acres and is located west of Oneta Road, north of State Highway 51. Kum and Go is proposing to construct a 6,321 square foot new store on this property and close their existing store on the east side of Oneta Road. The south part of this property was previously platted as, Lot 1, Block 1 of BOL Addition. On January 19, 2016, the City Council approved the vacation of the BOL Addition plat.

 

On February 16, 2016, the City Council approved a Conditional Final Plat for Kum & Go #837 that contained 1.72 acres, subject to a checklist. After this plat was approved, the applicant acquired Lot 9, Block 2, Prairie Dale, immediately to the north.  Per the covenants, for Prairie Dale Addition, most of the property had limited use (including Lot 9, Block 2) to single-family residential uses. 

 

Lot 9, Block 2, Prairie Dale Addition was annexed into Broken Arrow on July 5, 2016 (Ordinance 3438). A Certificate to Vacate Lot 9, Block 2, Prairie Dale Addition was recorded in Wagoner County prior to the annexation into the City of Broken Arrow that released the covenant conditions, and restrictions set out in the plat for Lot 9, Block 2 Prairie Dale Addition,

 

On August 11, 2016 a revised Preliminary Plat was approved, that incorporates Lot 9, Block 2, Prairie Dale Addition with the rest of the property, subject to a checklist. In addition, a revised PUD document, PUD-247A, and rezoning request (BAZ-1962) were approved by the Planning Commission, with the suggestion that a condition be added to the PUD design statement stating, “Onsite signage shall be posted on the property prohibiting overnight parking.”  

 

This Conditional Final Plat of 3.33 acres, was reviewed and approved by the Technical Advisory Committee (TAC) on August 23, 2016. The Planning Commission, in their meeting of August 25, 2016 reviewed and unanimously (5-0 vote) recommended that PT15-119A be approved as recommended by TAC and Staff, subject to the checklist. There were no protestants.
