Consideration, discussion, possible approval and direction to publish an Amended Legal Notice of Annexation for the voluntary annexation of property for a Planned Unit Development named Walnut Grove on 7.834 acres of land located in the South Half (S/2) of the Northwest Quarter (NW/4) of Section Eight (8), Township Seventeen (17) North, Range Fourteen (14) East of the Indian Base and Meridian, Tulsa County, State of Oklahoma and located south of the Southeast corner of the intersection of East 131st and South Garnett Road
End
Background:
At the request of the property owner, the City of Broken Arrow is proposing to annex 7.834 acres generally located near the Southeast corner of the intersection of East 131st Street and South Garnett Road.
Pursuant to Title 11, Section 21-103 of the Oklahoma Statutes, the Council must direct publication of a Notice of Annexation in a legally qualified newspaper of general circulation fourteen (14) days prior to the public hearing notifying property owners abutting any public right-of way that forms the boundary of the territory of the proposed property to be annexed.
This Amended Legal Notice of Annexation is necessary because the original date for the adoption of the ordinance and public hearing was scheduled for November 3, 2015. This meeting had to be rescheduled to November 10, 2015, in order to accommodate the City Council Members’ attendance at the 2015 National League of Cities Annual Conference. The ordinance will be previewed at the November 9, 2015 meeting and the Public Hearing and final adoption of the ordinance will take place on November 17, 2015.

Recommendation:
Direct the City Clerk to publish the Amended Legal Notice of Annexation in a legally qualified newspaper 14 days prior to the public hearing and mail the Notice in accordance with State Law.
