                     Approval of and authorization to execute a license for Oklahoma Turnpike Authority Utility Crossing associated with the Cottages at Cedar Ridge Sanitary Sewer located east of Garnett Road and a half-mile south of Washington Street

Background:                                          Case and Associates Properties, Inc. has proposed a multi-family luxury                                                                                     apartment complex on a portion of the former Grace Fellowship property                                                                                     located west of Garnett Road and a half-mile north of 101st  Street (just                                                                                     south of the Creek Turnpike.

 

                                                               The lay of the land is west to east.  They have worked with City staff for                                                                                     approval to gravity flow sanitary sewer across Garnett Road and connect                                                                                     to the existing 48-inch Haikey Creek sanitary sewer trunk line.  In order to                                                                do this they also had to coordinate with and receive approvals from City of                                                                Tulsa, Tulsa County, Oklahoma Turnpike Authority (OTA), Corps                                                                                                          of Engineers and Department of Environmental Quality.  Coordination                                                                                     with each entity has occurred over the past year with subsequent approvals                                                                from each and interlocal coordination and meetings.

 

The proposed sanitary sewer line runs west to east from Garnett road near the Creek Turnpike along the northern 25 feet of OTA property, which is located in the City of Broken Arrow and part of a wetlands area.  Since this proposed 15-inch sewer line portion east of Garnett Road will be dedicated to the City of Broken Arrow as a public utility, OTA requires the City sign a license for utility crossing and a right-of-access (separate submitted fact sheet and documents). 

 

                     Case and Associates has prepared the license for utility crossing and support documents and fee.  Case and Associates also has agreed to provide annual mowing and maintenance over and along this 25 foot permanent sanitary sewer easement.

 

                                                               City staff have reviewed the license and documents and recommends                                                                                     approval.
