Background:

Park at Adams Creek Detention Facility was constructed around 2001 as part of the KMO Development Group Project.  The location of the detention facility is located north of Hillside Drive between Dick’s Sporting Goods and Lowe’s.  The design and construction of the detention facility was before the fee-in-lieu of detention ordinance was adopted in 2002.  The area detained by the detention facility is approximately 260 acres.  The boundaries are: 9th Street to the west, 23rd Street to the east, Broken Arrow Expressway and Kenosha Street to the south, and the half section line to the north.  The Park at Adams Creek Detention Report dated May 2001 states the calculated developed flow leaving the detention facility is less than the existing flow.  Therefore, the detention facility meets the intent of the current ordinance to maintain or reduce the flow leaving the site.

The Park at Adams Creek Property Owners Association donated the 25.59-acre detention facility to the City of Broken Arrow for stormwater detention, maintaining existing wetlands, and certain considerations.  City Council accepted the Deed of Dedication on August 7, 2010.

Staff recommends the City of Broken Arrow consider the donation of the regional detention facility as “some other form of valuable consideration in lieu of building a detention facility” in accordance with Ordinance Section 25-207.  The 260 acres draining to this detention facility would therefore not be required to build an additional detention facility or make monetary payment since the value of the dedication accounts for that fee-in-lieu-of on-site detention payment.
