Approval of and authorization to execute Resolution No. 1657, a Resolution authorizing acceptance of a General Warranty Deed for Parcel 5.0, consisting of 12,516 square feet of permanent Right-of-Way and one Drainage Easement consisting of 1,340 square feet, generally located near the northwest corner of 9th Street and Washington Street in Broken Arrow, Oklahoma, in the Southeast Quarter of Section 14, Township 18 North, Range 14 East, Tulsa County, Oklahoma, from Gerardo Yanez and Elizabeth Yanez, and authorization of payment in the amount of $57,740.00 for the 9th Street widening from Houston Street to Washington Street, Parcel 5.0 (Project No. ST2027)

Background:
The attached General Warranty Deed is being conveyed to the City of Broken Arrow, a municipal corporation, from Gerardo Yanez and Elizabeth Yanez, the owner. Parcel 5.0 consists of 12,516 square feet of permanent Right-of-Way generally located near the northwest corner of 9th Street and Washington Street in Broken Arrow, Oklahoma, in the Southeast Quarter of Section 14, Township 18 North, Range 14 East, Tulsa County, State of Oklahoma. Gerardo Yanez and Elizabeth Yanez have accepted the following offer, made subject to City Council approval:
Permanent Right of Way: 12,516 square feet @ $3.50/square foot = $43,806
Perpetual Drainage Easement: 1,340 square feet @ $3.50/square foot x 75% = $3,518
Improvements to be Acquired: Acquire gravel drive 450 SF # $2.00/SF x 0% Depreciated = $900; Acquire concrete drive 300 SF @ $10.00/SF x 0% Depreciated = $3,000 Total: $3,900
Replace Vinyl fencing: 3 Rail Vinyl Fence: 180’ x $26/foot = $4,860; Demo existing fence: 180’ x 3.50/foot = $630; Single Swing Drive Gate: $1,200 Total: $6,510
Total Just Compensation Amount (Rounded) = $57,740
A copy of the signed acceptance of the City’s offer is attached, as is the General Warranty Deed. Payment of the compensation amount is on the May 20, 2025 City Council Claims List.
