Background:

BAZ 1957 is a request to change the zoning designation on this 0.14 acre triangular shaped tract from R-3 (Single-Family Residential) to DM (Downtown Mixed-Use Core). In conjunction with BAZ 1957, the applicant has also submitted SP-276, for micro-food and beverage production. This property is located on the southeast corner of Cedar Avenue and Dallas Street and is platted as a portion of Lots One (1) and Two (2), Block Fifty-three (53), of Broken Arrow Original Town.

 

Applicant is interested in remodeling the existing building on the property for use as a micro-brewery. Per Zoning Ordinance No. 3436, adopted June 6, 2016, micro-food and beverage production in the DM district is permitted with an approved Specific Use Permit and this Specific Use Permit request is in accordance with this new Ordinance.

 

Per information provided by the applicant, this proposed micro-brewery will be to renovate the existing building back to its original form, with 2,800 square feet of the 4,600 square feet used. Due to current State laws, beer brewed on-site cannot be sold straight to the public from this site. Proposed hours of operation will be from 10:00 am to 8:00 pm and if the State law is changed to allow beer sales on-site, the hours of operation will be from 10:00 am to 11:00 pm. Truck deliveries and pick-ups are expected to be minimal. Heavy duty vehicles are expected to visit the site one to two times a week only. It is anticipated that beer will be brewed two to three times a week with an annual production of 928 barrels (A barrel is 31 gallons, 928 x 31 = 28,768 gallons). Per current State laws, 100% of the beer sales will be through distribution and the number of employees, will be limited to the three partners. If the State law is modified to allow consumption on site, the number of employees on-site will be 8 to 9.

 

The Planning Commission in their meeting of May 26, 2016 reviewed and unanimously (4-0 vote) recommended approval of BAZ 1957 and SP 276, as presented and with the suggestion that re-platting be waived, per Staff recommendations. There were no protestants.
