End
Background:
The City of Broken Arrow contracts with the Tulsa Business and Legal News and the Wagoner Tribune to meet its statutory requirements for legal notices and publications in Tulsa and Wagoner County. Recently, the Tulsa World purchased the Tulsa Business and Legal News, the Wagoner Tribune and the Broken Arrow Ledger. During the acquisition and reorganization process, several items sent for publication to the Tulsa Business and Legal News were inadvertently omitted. This resulted in publication in the Wagoner Tribune, but not the Tulsa Business Legal News.
State statute requires that before an Ordinance can become legally effective, it must first be published in a newspaper of general circulation within fifteen (15) days after its adoption by the governing body. The attached corrected ordinance is being submitted to the City Council for adoption so that all legal publication requirements will be met.
Council Members may recall that rezoning case BAZ 1901 (AR-1 to RS-1) was approved by the Broken Arrow City Council on January 21, 2014. Since there were no changes in utilities, easements, or right-of-way lines, platting was waived.

A tract of ground situated in the North half of the Southwest Quarter (N/2 SW/4) of Section Two (2), Township Seventeen (17) North, Range Fourteen (14) East of the Indian Base and Meridian Tulsa County, State of Oklahoma, according to the United States Government survey thereof, and being more particularly described as follows, to-wit:
Beginning at a point on the North line of the SW/4, 2,014 feet East of the Northwest corner thereof; thence East along said North line an distance of 167 feet; thence South on a line parallel with the West line of Section 2, a distance of 302 feet; thence West parallel with the North line of the NW/4, a distance of 167 feet; thence Northerly a distance of 302 feet to the point of beginning, and known as 16609 East 127th Street South.
