Lot Split request LOT-001649-2024 involves 34.42 acres. The property is currently 1 lot, and the proposed exhibit shows 3 lots. The property, which is located at 3226 N Elm Avenue, is currently un-platted and undeveloped.
In the A-1 (Agriculture) zoning district, the minimum lot size is 5 acres with a minimum frontage of 330’. LOT-001649 proposes to create a southern lot of 8.94 acres, an eastern lot of 5.76 acres, and a northern lot of 19.72 acres. All of these lots have more than 330’ of frontage onto North Elm Place. The Subdivision Regulations only allow for 2 lot splits to create 3 lots before platting is required. The applicant is aware that platting will be required to create any future lots on these parcels.
The northern lot currently has a single-family house under construction. BLDR-011708-2023 is the building permit for this property, which currently has a temporary certificate of occupancy. A permanent certificate of occupancy will be issued as soon as the reduced sidewalk escrow is paid ($31,491.00). The partial sidewalk waiver was heard by Planning Commission on 7-25-2024 and approved by City Council 8-20-2024 per Planning Commission Recommendation.
Access to all three of these parcels is provided by a mutual access easement which is laid over the existing driveway that cuts through each of the proposed lots.
According to FEMA Maps, none of this property is located within the 100-year floodplain.
LOT-001649-2024 was discussed by the Technical Advisory Committee on September 3rd, 2024. Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Windstream, and Cox Communications did not indicate any issues with the proposed lot split.

Recommendation:
Staff recommends LOT-001649-2024 be approved, subject to:
• New warranty deeds for both parcels being brought simultaneously to the Planning & Development Division to be stamped prior to being recorded in Tulsa County.
• The Certificate of Occupancy being issued for BLDR-011708-2023
• All easements being dedicated prior to the lot split being filed with Tulsa County
