Lot split request BAL 1087 involves a 160.00 acre parcel located on the northwest corner of Kenosha Street and 209th E. Avenue.  Broken Arrow Public Schools, which is in the process of acquiring 42.00 acres of the 160.00 acre tract, plans to build an elementary school and middle school on the unplatted property.  No other uses are proposed at this time for the remaining parcel.

 

BACP 150, a request to change the Comprehensive Plan designation on this property from Levels 3 and 4 and “Public/Semi Public” to Levels 2 and 4 and “Public/Semi Public”, has been submitted in conjunction with this lot split.  In addition, SP 275, a request for a Specific Use Permit for the elementary and middle schools, has also been submitted.  Since the property is unplatted, the amount of right-of-way and utility easements required by the Subdivision Regulations may not have been provided.

Recommendation:                     

Staff recommends BAL 1087 be approved, subject to the following:  

 

1.                         Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Wagoner County. 

 

2.                         Prior to the warranty deeds being stamped, any additional right-of-way and utility easements that are needed to be in compliance with the Subdivision Regulations along Kenosha Street and 209th E. Avenue for the entire existing parcel shall be dedicated.
