SP-003165-2026 is a request for a Specific Use Permit for a proposed residential accessory structure. The property is zoned RE (Residential Estate), is unplatted, and is located one-third mile north of New Orleans Street (101st Street) and 800’ west of 23rd Street (County Line Road/193rd East Avenue).

The owner of this property located at 18951 E 97th Street built a 2,000-square-foot accessory structure that is larger than what is allowed on properties that are two acres or less in area, and he was cited by the Chief Building Inspector for doing so without a permit. The applicant has since submitted a building permit application that is on hold until this request for a Specific use Permit is resolved. Under Section 2-4-1(C)(2)(b), the maximum allowance of 1,200 square foot for lots 2 acres or less, unless a Specific Use Permit is approved allowing a larger structure.

The approval of this request would result in seven percent (7.23%) lot coverage. The site plan provided indicates that the plan meets the minimum setback requirements. However, staff cannot be certain of this without a survey created by a licensed surveyor. Should the Planning Commission support approval of the Specific Use Permit, staff recommends that it be subject to the applicant producing an official survey of the property indicating precise setbacks prior to going before City Council with this request. Should the Planning Commission support this request, it will be placed on the December 1, 2026, City Council agenda. However, if the recommended condition of approval to submit a satisfactory property survey prepared by a licensed land surveyor has not been met in time for that meeting agenda, staff will recommend that this item be tabled to a future City Council agenda.

Recommendation:

Based on the Comprehensive Plan, the location of the property, and the surrounding land uses, Staff recommends that SP-003165-2026 be approved subject to the following conditions:

1.                     Prior to this Specific Use Permit being placed on the City Council agenda, the applicant shall submit a survey signed and sealed by an Oklahoma licensed professional land surveyor showing the property boundaries, acreage, existing building locations, accessory-structure setbacks, and separation from the principal structure. Staff shall verify compliance with applicable dimensional requirements, including any separately approved dimensional relief. This permit authorizes the accessory-structure floor area only and grants no setback or building-separation relief.

2.                     Any outstanding citations from the Building Inspections Division, building permit and inspection requirements shall be addressed separately from the Specific Use Permit request.
