Consideration, discussion and possible adoption of Ordinance No. 3411, an ordinance amending the Broken Arrow Code of Ordinances by amending Chapter 23, Traffic, Division 2, Parking Meters; Section 23-154. - Meter zones; installation of meters; marking of metered spaces; and parking zones, specifically deleting Section 23-154(C)(1) and (2) which defines the boundaries of the central business district, deleting reference to the central business district to be replaced by the Rose District; and to allow defendants who receive parking citations in the area to request to be placed on a Municipal Court docket to be heard before a Municipal Court Judge; repealing all ordinances to the contrary; and declaring an emergency

Background:

The Police Department has received multiple complaints from merchants located in the Rose District regarding vehicles being parked longer than the 2 hour posted limit in the District. After reviewing the relevant ordinances, it was determined that Section 23-154 should be amended. Currently, the ordinance refers to a central business district and identifies the boundaries of such district. Since the ordinance was adopted, the Council has officially named the area the Rose District and has extended the boundaries.

Currently, parking citations for violating the 2 hour parking limitation includes a fine of $5 dollars. The Police Department has suggested implementing new citations for this violation and other similar violations in the area that would include a fine of $25 dollars. These citations would be able to be paid not only at the Justice Center, but also at the One-Stop Center and the Water Department. If the violator chooses to contest the citation they can request to be placed upon a docket to appear before the Broken Arrow Municipal Court Judge. The new citations would allow officers to more easily enforce the 2 hour limit parking and deter such violations. The amendment will include this new fine and process.
