Background:

The owner of the property, Dan McKay is requesting partial closure of a utility easement on his property.  This request is to close 8’ of the 40’ utility easement located along the east boundary of the utility easement.  The closure is to allow construction of an accessory structure on the property.  

 

Mr. McKay originally requested the closure in January of 2014, the application was processed and the item went to the City Council as a preview ordinance May 6, 2014.  There is no known reason why the ordinance never went to City Council for final adoption.  Mr. McKay contacted the City in May of 2015 asking the status of his utility closure and Staff was unable to locate the final closing documents and was advised by the Legal Department to proceed with the ordinance adoption.   

 

Staff has reviewed the documents and recommends approval of the request.  Utility companies have also reviewed and do not object to the partial closure.
