Lot split request BAL 1081 involves a 10.00 acre parcel located one-half mile south of Tucson Street, east of Olive Avenue.  Applicant is requesting to split the property into two equal size lots.  Their residence is currently on the south tract.  They are proposing to build a new residence on the north tract.  The A-1 district only allows one residential structure per lot.  As a result, they are requesting to split the property in half.

 

The property presently has 658.75 feet of frontage along Olive Avenue.  With the proposed lot split, the lots will have 329.37 feet of frontage onto Olive Avenue, which is slight less than the 330 feet of frontage required by the Zoning Ordinance.  In the past, the Planning Commission has approved similar type requests.  The lot meets the minimum lot size and building setback requirements of the A-1 district.

 

Water to the existing residence on Tract 2 is presently provided by a well.  A new subdivision (Stone Horse of Broken Arrow) is under construction immediately south of the property associated with BAL 1081.  Applicant is exploring the possibility of being able to connect both lots onto the water system at Stone Horse.  If this cannot be achieved, a new well will be constructed on Tract 1.  The main water line along Olive Avenue stops with the Stone Horse development.

 

The west edge of the property next to Olive Avenue is located in the 100-year floodplain of White Church Creek.

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split.

Recommendation:                     

Staff recommends BAL 1081 be approved, subject to the following:  

 

1.                         Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Tulsa County. 

 

2.                        Right-of-way and utility easements shall be dedicated in accordance with the Subdivision Regulations along Olive Avenue prior to the warranty deeds being stamped.  From the section line, this requires 50 feet of right-of-way dedication and 17.5 feet of utility easement dedication.
